An inspector from the MSSS (Ministère de la Santé et des Services sociaux) showed up unannounced in my dental office. He wanted to make sure that my dental office complies with the Tobacco Control Act and the Act respecting medical laboratories, organ and tissue conservation and the disposal of human bodies. Am I required to accommodate him?
Yes. Under section 32 of the Tobacco Control Act, and section 149 of the Act respecting medical laboratories, organ and tissue conservation and the disposal of human bodies, MSSS inspectors are authorized to make certain checks, such as whether your office complies with the rules that prohibit tobacco use or whether your X-ray machines are kept in good functioning condition, as far as their shielding and calibration are concerned.
However, inspectors must provide you with proof of identity and produce a certificate of appointment signed by the Minister of Health. You are required to assist inspectors and not hinder them in the performance of their duties.
